By placing an order with us, the Customer / you agree to our Terms and the Terms and Conditions of USPS, Federal Express and UPS, our courier delivery service.

TERMS OF USE & DECLARATION OF INTENT:

 

The end-users of Pansatpro.com products need to read and agree to the Terms of Use and Declaration of Intent. The sale of our product is contingent upon these terms. The user of Pansatpro.com products agrees to the terms below.

I, the user, understand that certain satellite television equipment sold legally may nevertheless be used in an unauthorized manner to aid in the theft of satellite television services. I, hereby declare that I understand that the law provides for substantial criminal and civil penalties for the theft of satellite television services, and that I will not use Pansatpro.com products in any way whatsoever to intercept any satellite television signal without proper authorization from the local satellite service provider and payment of all lawful charges, and I will only use the equipment in accordance with all applicable laws.

Shipping and Insurance:

We ship worldwide.

Customer is responsible for risk of loss on all shipments.   The address we ship to is the billing address on the order form if payment is via credit card.  In other words, we only ship to Billing address of the credit card on the order form if order is paid with credit card. 

For USA orders we use FedEx, UPS, USPS priority Mail. EACH PARCEL IS INSURED AUTOMATICALLY FOR $100 BY UPS / FedEx. ADDITIONAL INSURANCE ($1 fee per additional $100 insurance) IS OPTIONAL BUT ADVISED.  For P. O. box orders, we use usps.  For usps, $1 fee per each $100 insurance IS OPTIONAL BUT ADVISED.  Customer needs to indicate the insurance (usps) or additional insurance for FedEx / UPS, or any additional shipping protection with any courier such as signature service (additional $3.00) customer wants in the Message Box provided during check out either shipping via FedEX / UPS / usps.  We will charge your credit card the additional insurance fee.  Shipping Fees for Puerto Rico, Hawaii are twice the amount as the continental 48 states of USA.  

For international orders, partly due to the custom and duty issues, we have to use United States Postal Service Air Parcel shipping. We used to use FedEx / UPS but ended up that the Courier companies, FedEx / UPS, charged our account for the custom duty, if any, instead of charging the customer.  Please note that United States Postal Service does not provide tracking number for international / Air Parcel shipments.  There will be no tracking number for shipment to International countries UNLESS if the customer paid extra fee to upgrade to Global Express Mail.  We seldom have any experience of loss in shipments, but Customer is solely responsible for any orders / items held up or confiscated by the Custom Office or stolen by corrupted officials, or loss on any shipments.  INSURANCE ($1 fee per $100 insurance) IS OPTIONAL BUT ADVISED. Customer needs to indicate the value of insurance customer wants in the Message Box provided during check out and Customer is responsible for the payment of the insurance fee.

International shipments / orders, customer can upgrade to use Global Express Mail for faster delivery (3-5 days arrival), and shipment with tracking number service, instead of the International Air Mail (Our Standard Service) by paying a little more. Please contact us for quotes.

International shipping via United States Postal Service Air Parcel Service (Our Standard Service) is $20 more for each receiver than the domestic shipping to the 48 States.  (Please note that this $20 is not the fee for upgrade to Global Express Mail). The domestic shipping is usually $20 per receiver.

Any goods received damaged must report to us, www.pansatpro.com, within 5 days of the date of receipt and Customer is responsible for filing the claims with the Courier Company, FedEx / UPS / USPS.

Delivery and Delay.  Delivery of goods covered hereby to a carrier at Seller’s plant or other loading point shall constitute delivery to Buyer / Customer.  All costs of transportation and risks of loss or damage of goods in transit shall be borne by Buyer / Customer and any such loss or damage shall not relieve Buyer / Customer of any obligation hereunder.  Seller (www.pansatpro.com) reserves the right to make partial deliveries.  Seller (www.pansatpro.com) shall not be liable for any loss or damage (including without limitation consequential or punitive damages) as a result of any failure of Seller (www.pansatpro.com) to perform, any delay in delivery due to any cause beyond Seller’s reasonable control including, but not limited to, acts of God, acts of Buyer, fire, explosion, theft, accident, flood, weather, war, sabotage, riot, epidemic, act of civil disobedience, slow down, strikes or other labor difficulties, embargo, government act, regulation, rule, ordinance, or request, or inability to obtain necessary labor, materials, manufacturing facilities, or transportation.  Shipping dates are estimates only and are dependent upon prompt receipt of all necessary information from Buyer / Customer.  In any event, no breach shall be found if the goods herein specified are delivered within a reasonable time after the delivery date set forth.  Unless Seller (www.pansatpro.com) specifically agrees otherwise in writing, all items shall be packaged and packed in accordance with Seller’s standard practices, and all goods shall be shipped uninsured.

Cancellation:

If you cancel an order after paying for it and BEFORE order shipment, a non refundable fee of 7% of the total transaction amount of the order will be applied (the credit card processing fee charged by the credit card company).  After order is shipped, it would be treated as return (see Refund and Return).

Refund and Return:   

Seller (www.pansatpro.com) will only accept equipment for refund or exchange or store credit that is in as-sold condition, with all original packaging and hardware, within 15 days of its original purchase date.  All returns are subject to 30% restocking charge.  No returns or refunds are allowed on antennas / dishes, special orders and closeout models.  No refund on shipping and handling charges for all items.  For example, $20 SHIPPING & Handling fee for each receiver is NON REFUNDABLE. 

FTA receivers come pre-programmed with the manufacturer's FTA software that enables you to receive all of the free to air channels offered by free to air satellites.  We provide customer support for the pre-programmed manufacturer's software only.  Downloading anything other than the manufacturers Free To Air program could be illegal and will definitely void your warranty.  We do not provide support for program downloads that may enable you to receive Pay Per View channels.  Receiving Pay Per View channels without paying for them is illegal and we will not assist you in acquiring the means to receive them.  Any attempts to program the unit to view satellites 119, 110, Direct TV, Dish Network or Bellvue will void your warranty and no exchange nor repair will be offered.  If your unit has a genuine defect then your unit's first 2 year warranty can be enforced by returning it to its respective manufacturer for repair / exchange.  Your unit's respective manufacturer address can be attained from us via email or phone.  If you are returning your unit to us for a refund, all returns are subject to diagnostics test by our engineering department.  We are able to detect unauthorized / illegal third party software on units used to view satellites 119, 110, Direct TV, Dish Network or Bellvue even if they have been factory reset.  If this is the case, then your warranty will have been voided.  You will need to mail a prepaid shipping label to us for delivery of the unit back to you.  If you have not downloaded any unauthorized / illegal third party software onto your unit and are generally dissatisfied with its performance then you may contact us for an RMA # for a refund.  All returns for refund are subject to a 30% restocking fee. Initial shipping cost to ship the unit are non refundable. Customers are responsible for shipping fees to return the unit to us.

Customer MUST notify us via email before returning the product to us and MUST request and obtain a RMA (Return Merchandise Authorization Number) and the return department address. There is NO REFUND / Exchange without the RMA.  NO EXCEPTIONS. 

This is the identification for the return package so that we can refund customers properly into their correct accounts. CUSTOMERS MUST PROVIDE THE RMA IN THEIR RETURN PACKAGES.  We are not responsible for any refunds including but not limited to, the return package was lost without a RMA, etc..  Customer is responsible for shipping charges and risk of loss on all return shipments.  We highly recommends using a reputable shipping carrier capable of providing proof of delivery, as well as properly packing and fully insuring your return shipment.  Returns are accepted only if your shipment was sent back to us within 15 days of original shipment date.  All returned units must be in the new, original, resalable condition. By this we mean: No parts of the unit should be damaged. Shipping carton should not have anything written on it. 

All items must be returned complete and with all original parts / documentation and in factory fresh, resalable condition. Effective as of January 1, 2005, any missing parts will be deducted from amount credited or be charged for the amounts due from the customer's credit card after the refund as a separate charge. Items returned with missing accessories (i.e. remote controls, wire harnesses, RS232 Data Cable, 4x1 switch, etc.) are subject to a charge for the replacement of these missing items. Missing manual, Component Audio & Video Cable, will be charged $10.99 each, RS232 Data Cable, $10.99, 4x1 switch $12.99, Battery set, $3, etc..  Items or units returned physically or cosmetically abused intentionally or unintentionally (such as scratches on the item, or torn paper carton box, etc.) will not be accepted for credit. NO EXCEPTIONS. Customer is responsible for the shipping charges and arrangement for courier pick up if he/she wants to have the items back. We, the merchant, pansatpro.com is not responsible for holding the goods for more than 30 days from its original return date. The goods will be discarded after 30 days.

All of our FTA receivers are covered with a manufacturer`s warranty. We do not accept defective units back to our location for the first 2 years, for Coolsat 5 years.  You must contact manufacturer for their warranty service.  Warranty will be honored by the manufacturer ONLY.

Refused Delivery:

 

Customer will be responsible with all charges associated with Shipping and Handling and will be subjected to a 20% restocking and processing fee of the original purchasing amount.

Chargeback:

We are nice and honest seller. We always strive to do our best to accommodate our customers' any requests. Customer are welcome to file any dispute with their credit card companies should they desire.  As with many merchants, we have experienced many fraudulent chargeback.  As of January 1, 2005, if the customer lose / does not win the dispute, in other words, if the dispute outcome decided by such said credit card company / financial institution is in the favor of Pansatpro.com, Customer will be charged the dispute fee, $25, plus a 10% of the total chargeback amount as the administrative fee. The $25 is to reimburse the $25 dispute fee that is charged to us, www.pansatpro.com, by the credit card company / financial institution.

Miscellaneous:

This Terms of Service / Agreement and any operating rules for Pansatpro.com established by Pansatpro.com constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the State of New York, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.

Any affiliates or employees of Pansatpro.com, is not required nor responsible for making suggestions or recommendations on products or suitability of any kind to the customers. The customer will be the sole responsibility for, and if, any damages incurred from such transaction / communication.

We are not responsible for, and if, the satellite companies changes signals in the future. This is not an acceptable ground for any product return.

Pansatpro.com shall have the right at any time to change the Terms and Conditions, cancel any orders placed with us, or refuse service to anyone, without prior notice.

Please note our products are not modified and we do not offer any DSS files, or any other non-factory software. Modifying or installing non-factory software onto our Free to Air satellite receivers voids all manufacturer warranties.

We do not sell to anyone with the intention to obtain illegal Satellite reception.

Any Receiver that has been modified, flash or with any illegal software that was uploaded will void the warranty.

Warning:

We do not provide or condone the use of third party software. Using third party software may be illegal and void product warranty. Do not email or call asking about DishNetwork, DirecTV, etc. Our satellite receivers are designed and intended for 100% legal use only. We will refuse sale to anyone whom we believe intends to use our product illegally or sell our products for illegal use.

PansatPro.com will not supply any illegal software for its products.
